Terms & Conditions.

These Terms & Conditions ("Terms") govern your access to and use of Nishchint (nishchint.ai), including our web and mobile applications and related services (together, the "Service"), operated by Xposure Media Consulting Private Limited, a company incorporated in India ("Nishchint", "we", "us", or "our").

By selecting “I agree” when creating an account, you accept these Terms. Our Privacy Policy explains how we handle personal data. Acceptance of these Terms does not replace any separate consent required for processing personal data. If you do not agree to these Terms, do not use the Service.

The Service is currently offered only to users in India.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Service. You must provide accurate age information. Accounts are not intended for individuals under 18.

2. The Service

Nishchint is a personal, AI-powered document vault. It helps you collect important personal documents (such as insurance policies, bank and investment statements, KYC documents, and medical records), organize them in one place, and understand them through AI-generated summaries, insights, and a chat feature.

You may add documents by:

• Manually uploading files (PDF, JPEG, PNG); and/or
• Connecting your Gmail account so Nishchint can identify and import document attachments (see Section 4).

We may develop features and apply reasonable usage limits. The features, limits and prices applicable to a paid plan will be shown before purchase. We will give reasonable notice of material changes affecting a paid service and provide any cancellation or other remedy required by applicable law.

3. Your Account

• You sign up using phone OTP or Google Sign-In.
• You are responsible for keeping your login details secure and for activity you carry out or authorise. This does not make you responsible for unauthorised activity caused by our failure to meet obligations under applicable law.
• You agree to provide accurate information and to keep it up to date.
• Notify us immediately at admin@nishchint.ai if you suspect unauthorized use of your account.
• One person may not maintain multiple accounts to circumvent usage limits.

4. Gmail Connection & Document Import

Connecting Gmail is optional. If you choose to connect it, you grant Nishchint read-only access to your Gmail for the sole purpose of identifying and importing document attachments into your vault, as described in our Privacy Policy.

• You may disconnect Gmail at any time from the app settings or via your Google Account permissions. Disconnecting stops future scanning; documents already imported remain in your vault until you delete them.
• Nishchint's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
• You are responsible for ensuring you are entitled to import and store any content you connect or upload, including documents that contain other people’s personal data (see Section 7).

5. AI Features — Important Disclaimer

Nishchint uses artificial intelligence (provided by third-party AI service providers listed in our Privacy Policy) to extract information from your documents, generate summaries and insights, and answer your questions in chat. You acknowledge and agree that:

• AI output may be inaccurate, incomplete, or outdated. Extracted fields (such as policy numbers, expiry dates, premium amounts, or account balances), insights, reminders, and chat answers are provided for convenience only and are not guaranteed to be correct.
• Nishchint does not provide financial, insurance, tax, legal, or medical advice. AI-generated content is not professional advice and must not be relied upon as such.
• You are responsible for independently verifying any important information — for example, confirming policy expiry dates, payment due dates, or medical details directly with the issuing institution or a qualified professional before acting on them.
• Reminders and alerts (such as "your policy expires in 15 days") are best-effort and may be missed, delayed, or wrong. Do not rely on Nishchint as your only source of critical deadlines.

These limitations explain the nature of AI assistance. They do not remove Nishchint’s responsibility to exercise reasonable care or exclude rights or remedies available under applicable law.

6. Your Content & Documents

• You retain the rights you hold in the documents and information you upload or import (“Your Content”). Uploading a document does not transfer ownership to Nishchint or give you ownership of another person’s rights in it.
• You grant Nishchint a limited, non-exclusive license to store, process, and display Your Content solely to operate and provide the Service to you (including AI extraction, insights, chat, and improving how accurately the Service finds and reads your documents), to keep the Service secure, and to comply with law.
• We do not sell Your Content, and we do not use it to serve advertising. We do not use Your Content, your Gmail data, or your chats to train generalised AI models.
• You are responsible for maintaining your own backups of important documents. The Service is a convenience vault, not a substitute for original records or an official system of record.
• You may request deletion of individual documents or your account through available app controls or by emailing admin@nishchint.ai. Deletion, backup treatment and lawful retention are described in the Privacy Policy.

7. Acceptable Use

In compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree that you shall not host, display, upload, modify, publish, transmit, store, update or share any information or document that:

• Belongs to another person and to which you do not have any right;
• Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, or encouraging money laundering or gambling;
• Is harmful to children;
• Infringes any patent, trademark, copyright, or other proprietary rights;
• Deceives or misleads the addressee about the origin of the message or knowingly communicates any misinformation;
• Impersonates another person;
• Threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order.

We may investigate and take action (including suspension or termination) for violations.

9. Third-Party Services

The Service relies on providers including Google for sign-in and optional Gmail access, AWS for hosting, storage and AI processing, and Razorpay for subscription payments. Relevant provider terms may also apply to your use of their services. Provider outages may affect availability, but do not remove Nishchint’s responsibilities to you under these Terms or applicable law.

10. Intellectual Property

The Service — including its software, design, text, graphics, logos, and the "Nishchint" name and branding — is owned by Xposure Media Consulting Private Limited or its licensors and is protected by intellectual property laws. Except for Your Content, nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

11. Privacy & Data Protection

Our Privacy Policy explains the personal data we process, its purposes and the controls and rights available to you. We obtain separate consent where required, and you can withdraw it as easily as you gave it, from Settings › Privacy in the app or by emailing admin@nishchint.ai. Withdrawal may affect features that depend on the relevant processing. Applicable statutory rights and complaint routes are subject to their commencement and applicability.

The Digital Personal Data Protection Act, 2023 also places duties on you when you share personal data with us or exercise your rights. You must not:

• impersonate another person when providing personal data;
• suppress material information when providing personal data for an official identity document;
• register a false or frivolous grievance or complaint with us or the Data Protection Board of India; or
• provide anything other than verifiably authentic information when you ask us to correct or update your personal data.

Breach of these duties may attract a penalty under the Act.

12. Disclaimers

We will exercise reasonable care and skill in providing the Service. We cannot guarantee uninterrupted availability or that AI output and reminders will always be accurate. These limitations do not exclude mandatory consumer rights or our obligations under applicable law.

We use reasonable security safeguards to protect your data, as described in our Privacy Policy. However, no system is completely secure, and we cannot guarantee that unauthorised access will never occur.

13. Limitation of Liability

Liability is determined under applicable law. You should verify important information and retain original records as explained in these Terms.

• Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any responsibility or remedy that cannot lawfully be excluded or limited, including applicable consumer and data-protection rights.

14. Responsibility for Misuse

You are responsible for unlawful or unauthorised use of the Service by you. Nishchint may pursue remedies available under applicable law for loss caused by that misuse. These Terms do not require you to accept responsibility for Nishchint’s own failures or waive mandatory rights.

15. Suspension & Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate access for a material breach, where required by law, or where reasonably necessary to protect the Service or others. We will act proportionately and provide notice and an opportunity to address the issue where practicable. Immediate action may be necessary for a serious security threat or legal requirement.
• On termination, your right to use the Service ends. Where lawful and practicable, we will provide a reasonable opportunity to retrieve your documents before deletion. Data handling follows the Privacy Policy. Any entitlement relating to unused paid service will be addressed under the Refund and Cancellation Policy and applicable law.
• If you have nominated someone as described in the Privacy Policy, that person may exercise your rights over your account and data in the event of your death or incapacity.

16. Changes to the Service or Terms

We may update these Terms and post the revised version. We will notify you of material changes before they take effect. Where affirmative acceptance is required, we will obtain it. Changes will not retrospectively remove accrued rights. New personal-data purposes are subject to separate notice and consent requirements described in the Privacy Policy.

17. Governing Law & Dispute Resolution

Indian law governs these Terms, subject to mandatory rights that apply to you. Disputes may be brought before courts, tribunals or consumer commissions with jurisdiction under applicable law. Nothing in these Terms removes statutory complaint routes or requires an exclusive forum that would restrict your legal rights.

18. General

• Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
• Entire agreement. These Terms, together with the Privacy Policy and any policies referred to in them, are the entire agreement between you and us about the Service.
• Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours in connection with a merger, acquisition, or sale of assets, as described in the Privacy Policy.
• No waiver. If we do not enforce a provision, that does not waive our right to enforce it later.
• Force majeure. Events beyond reasonable control may affect service availability. We will take reasonable steps to reduce disruption and restore service. This clause does not exclude obligations, refunds or remedies that apply under law.
• Survival. Sections 5, 6, 10, 12, 13, 14, and 17 survive termination of these Terms.
• Notices. We may send you notices by email, SMS, or in-app message. You may send notices to us at admin@nishchint.ai.
